PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING, BROWSING, OR PLACING AN ORDER ON THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS, OUR PRIVACY POLICY, AND ANY OTHER POLICIES POSTED ON THE SITE. IF YOU DO NOT AGREE, DO NOT USE THE SITE OR PLACE AN ORDER.

1. DEFINITIONS

For the purposes of these Terms & Conditions:

  • “Customer,” “you,” or “your” means any person or entity who visits the Site, creates an account, places an order, or purchases products from Triple A Food Mart.

  • “Products” means all items offered for sale on the Site, including but not limited to perishable food items, fresh produce, smoked or processed meats, live animals, and non-perishable kitchenware.

  • “Order” means a purchase placed by a Customer for Products through the Site.

  • “Delivery” means the transfer of Products from Triple A Food Mart (or its delivery partner) to the Customer or Customer’s designated pickup agent.

2. ACCEPTANCE OF TERMS

By creating an account, placing an Order, or otherwise using the Site, you represent that you are of legal age to form a binding contract and you accept and agree to these Terms & Conditions and any policies incorporated by reference (including our Privacy Policy, Shipping & Delivery Policy, and Refund & Return Policy). If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. CHANGES TO TERMS

We may update these Terms from time to time. When we do, we will post the updated Terms on the Site with a revised Effective Date. Your continued use of the Site after a change to the Terms constitutes your acceptance of the updated Terms. It is your responsibility to review the Terms regularly.

4. ELIGIBILITY

You must be at least 18 years old to place an Order. If you are under 18, you may only use the Site with the involvement of a parent or guardian. Certain Products (e.g., live animals, restricted food items) may be subject to additional age, location, or licensing restrictions and may not be available to all customers.

5. ACCOUNT CREATION & SECURITY

  • Account Registration. To place Orders and access certain features, you may be required to register and create an account. You must provide accurate, current, and complete information during registration and update that information to keep it accurate.

  • Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access or a breach of security.

  • Account Termination. We reserve the right to suspend or terminate your account, at our discretion, if we suspect fraudulent activity, violation of these Terms, or conduct harmful to our business or other customers.

6. PRODUCT INFORMATION, DESCRIPTIONS & IMAGES

  • We strive to provide accurate product information, images, sizing, weights, and ingredient lists. However, Product descriptions, images, and other content on the Site are approximate and are subject to change without notice.

  • Weights & Portions. For items sold by weight (e.g., produce, meats), actual delivered weight may vary. Displayed weights and portions are estimates and final prices may be adjusted to reflect the actual weight where applicable.

  • Ingredients & Allergen Information. We provide ingredient and allergen information where available. Customers with allergies or special dietary needs must review all product information before purchase and assume responsibility for verifying product suitability. We are not liable for adverse reactions if you fail to review product details or disclose allergies at time of purchase.

7. ORDERING & ACCEPTANCE

  • Placing an Order. Orders placed on the Site constitute an offer to purchase. After you place an Order, you will receive an Order confirmation by email. This confirmation is an acknowledgement, not an acceptance of your Order.

  • Order Acceptance. We reserve the right to accept or decline Orders for any reason, including but not limited to product availability, pricing errors, suspected fraud, or shipping restrictions. If we are unable to accept an Order, we will notify you and issue a refund if payment had been processed.

  • Order Modification. Requests to change or cancel Orders should be submitted immediately to support@tripleafoodmart.com. Orders for perishable products, live animals, or processed meats may not be canceled or modified once harvesting, processing, or packing has begun.

  • Pricing & Errors. Prices on the Site are subject to change without notice. In rare cases we may list a price incorrectly; we reserve the right to correct such errors and to cancel Orders placed at incorrect prices. If an incorrect price is discovered after the Order is placed, we will contact you to confirm whether you wish to proceed at the correct price or cancel the Order.

8. PAYMENT TERMS

  • Payment Methods. We accept the payment methods displayed at checkout. Payment is due at the time you place your Order unless other arrangements are explicitly agreed to in writing.

  • Charges. You authorize us to charge the payment method you provide for all amounts due for Orders, including taxes, shipping fees, handling, and any applicable surcharges.

  • Fraud Prevention. We may use third-party services to validate payment methods and screen for fraud. We reserve the right to refuse or cancel any Order if we suspect fraud or identity theft.

  • Taxes. Prices displayed may not include applicable federal, state, or local taxes. You are responsible for paying any taxes due. Where required, taxes will be calculated and added at checkout.

9. SHIPPING & DELIVERY

  • Policies Apply. Our Shipping & Delivery Policy governs shipment, shipping costs, delivery windows, inspection, and acceptance. For perishable goods, customers must inspect deliveries at the time of receipt and report any damage, spoilage, or discrepancies immediately as set out in our policies.

  • Delivery Acceptance. Once the delivery is accepted in good condition (including being signed for where applicable), the Order is considered delivered and accepted. Perishable products accepted in good condition are generally non-returnable.

  • Delivery Delays. We are not responsible for delays caused by third-party carriers, weather, natural disasters, holidays, or other events beyond our control. We will make reasonable efforts to notify you of delays. Additional delivery or reshipment fees may apply for failed deliveries or repeated delivery attempts.

10. RETURNS, REFUNDS & CANCELLATIONS

  • Perishable Products. Items that are perishable or that have a limited shelf life (such as fresh produce, smoked or frozen meats, and processed foods) are final sale once accepted at delivery or pickup, except where damaged or otherwise nonconforming as described in our Refund & Return Policy.

  • Live Animals. Live animals and processed animal orders are subject to a strict policy as set forth in our Refund & Return Policy. Inspections at pickup or delivery are required; once accepted, these sales are final.

  • Non-Perishable Items. Returns for kitchenware and other non-perishable goods are permitted according to our Returns Policy (e.g., within 7 days, unused, in original condition, return shipping rules).

  • Refund Processing. Approved refunds will be processed within a stated period (typically 3–7 business days) to the original payment method. Processing time may vary by bank or payment provider.

11. FOOD SAFETY, HANDLING & ALLERGENS

  • Safety Compliance. We operate under standard food safety practices and, where applicable, USDA inspection protocols. Our products are handled, packaged, and shipped using industry-standard food safety measures.

  • Customer Responsibility. Customers are responsible for proper handling and storage of perishable products upon delivery. We provide storage and cooking guidance where appropriate; you must follow these instructions to maintain safety and quality.

  • Allergen Notices. We take allergen risks seriously and provide disclosed information when available. However, cross-contamination can occur in production facilities. Customers with food allergies or sensitivities should exercise caution and may contact customer support to confirm details before purchasing. We are not liable for allergic reactions resulting from undisclosed or unknown allergens.

  • Recalls. If a product recall is issued for any Product you purchased, we will attempt to notify affected customers and provide instructions. You should also check your email and account notifications for recall communications. Follow recall instructions immediately.

12. LIVE ANIMALS & ANIMAL SALES

  • Local Restrictions. Sale and delivery of live animals are subject to local, state, and federal laws. Customers are responsible for ensuring they are legally permitted to purchase and possess live animals in their area.

  • Inspection at Pickup/Delivery. All live animals should be inspected at pickup/delivery. Any concerns must be raised immediately and documented. Once a live animal is accepted in good condition, the sale is final.

  • Transport & Care. Customers are responsible for timely pickup or proper arrangements for delivery. Prolonged delay in pickup may affect animal welfare; Triple A Food Mart may charge holding fees or cancel orders where welfare is at risk.

13. USER CONDUCT & PROHIBITED USES

When using the Site you agree not to:

  • Use the Site for any illegal purpose or in violation of these Terms.

  • Post or transmit any content that is unlawful, defamatory, obscene, harassing, or otherwise objectionable.

  • Interfere with or disrupt the Site or servers or networks connected to the Site.

  • Attempt to access other users’ accounts without authorization.

  • Use automated systems or software to extract data from the Site without our express written permission.

Violation of this section may result in removal of content, suspension or termination of accounts, and legal action.

14. INTELLECTUAL PROPERTY

  • Ownership. All content on the Site, including text, graphics, logos, images, designs, and compilations are the property of Triple A Farms and Food Processing Inc. or our licensors and are protected by intellectual property laws.

  • Limited License. We grant you a limited, non-exclusive, non-transferable license to access and use the Site and content for personal, non-commercial use in connection with purchasing Products. Reproduction, distribution, modification, or commercial use of Site content without our written permission is prohibited.

  • Trademarks. “Triple A Food Mart,” the Triple A logos, and other marks displayed on the Site are our trademarks or registered trademarks. You may not use these marks without our prior written consent.

15. USER CONTENT & REVIEWS

  • Submissions. You may submit product reviews, comments, photos, or other content (“User Content”) to the Site. By submitting User Content you grant Triple A Food Mart a perpetual, royalty-free, worldwide, transferable license to use, reproduce, modify, publish, and display the content in any media.

  • Guidelines. User Content must not infringe intellectual property rights, violate privacy rights, or be unlawful. We may review, edit, or remove any User Content at our discretion.

  • Responsibility. You are solely responsible for the User Content you submit.

16. THIRD-PARTY WEBSITES & SERVICES

  • The Site may contain links to third-party websites, resources, or services. We do not control third-party content and are not responsible for their policies, practices, or content. Your interactions with third-party sites are at your own risk.

  • We may use third-party services for payment processing, shipping, analytics, and marketing. These providers have access to personal information necessary to perform their functions and are bound by contractual obligations to protect your data.

17. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TRIPLE A FOOD MART DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT ANY DEFECTS WILL BE CORRECTED.

18. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPLE A FARMS AND FOOD PROCESSING INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE RELEVANT ORDER(S) GIVING RISE TO THE CLAIM.

This limitation does not apply to liability that cannot be limited under applicable law, including death or personal injury caused by our negligence.

19. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Triple A Farms and Food Processing Inc., its affiliates, officers, directors, employees, agents, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) your violation of any law or third-party rights; (c) your User Content; or (d) your use of the Site or Products in a manner not authorized by these Terms.

20. DISPUTE RESOLUTION & ARBITRATION

  • Informal Resolution. We prefer to resolve disputes informally. Please contact us at support@tripleafoodmart.com to attempt to resolve any dispute.

  • Binding Arbitration. If we cannot resolve the dispute informally, you and Triple A Food Mart agree to resolve disputes through binding arbitration in the county where Triple A Farms and Food Processing Inc. is headquartered, unless you opt out within 30 days of your first Order by contacting us. Arbitration will be conducted under the rules of the American Arbitration Association (AAA) and will be final and binding.

  • Class Action Waiver. You and Triple A Food Mart agree to bring claims individually and not as a class or representative action.

  • Exceptions. Either party may pursue injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of confidentiality or intellectual property rights.

21. GOVERNING LAW & JURISDICTION

These Terms and any disputes arising hereunder will be governed by and construed in accordance with the laws of the State in which Triple A Farms and Food Processing Inc. is incorporated, without regard to conflict of law principles. Venue for disputes will be the state and federal courts located in that state, subject to any arbitration agreement above.

22. FORCE MAJEURE

We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, shortages of materials, government actions, or transportation disruptions. In such events, we may suspend performance without liability and will make reasonable efforts to notify customers and fulfill Orders as soon as practicable.

23. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.

24. ASSIGNMENT

We may assign or transfer these Terms and our rights and obligations hereunder, in whole or in part, without restriction and without notice to you. You may not assign or transfer your rights under these Terms without our prior written consent.

25. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping & Delivery Policy, Refund & Return Policy, and any other policies posted on the Site, constitute the entire agreement between you and Triple A Farms and Food Processing Inc. with respect to your use of the Site and purchase of Products, superseding any prior agreements.
